Discussion on Expired Exploration Right——The Case of Zhejiang Province

摘要: 矿业权审批系统中过期未注销探矿权的存在,已成为国土资源管理部门面临的一个亟待解决的问题.探矿权过期的原因既有探矿权人自身原因,也有矿政管理部门、中介服务机构和国家政策等各方面的原因.为了解决这个问题,一是要加强制度研究,从制度上扫除壁垒;二是要加大清理工作,解决历史遗留问题;三是要创新监管方式,形成新的管理秩序.Abstract: The existence of expired but not canceled exploration right in the approval system of mining right has been an extremely urgent problem to be solved for mining administrative organizations.The reasons leading to expiration of exploration right could be resulted from the exploration right possessor, mining administrative organizations, intermediary service agencies and national policies.In order to solve this problem, the following three aspects need to be focused.Firstly, strengthening institutional research to remove barriers from the system;secondly, increasing the clean-up work to solve historical problems;thirdly, proposing innovative regulatory approach to form new management order.
